Board of Trustees of M.M.Adyshev Osh Technological University
The Board of Trustees of the M.M.Adyshev Osh Technological University (hereinafter referred to as the Council) is a non—governmental, non—governmental, non-profit, public organization that unites on a voluntary basis all those who are interested in developing high-quality public services in a particular institution.
The legislation of the Kyrgyz Republic on the Council consists of the Constitution, this Law and other regulatory legal acts of the Kyrgyz Republic.
The purpose and objectives of the Council
The purpose of the Council is to promote the improvement of the quality of services provided, food and medicines, transparency of the activities of social institutions, as well as the effectiveness of the use of extra-budgetary funds.
The objectives of the Council are:
1) assistance in creating conditions for the effective organization of the activities of social institutions;
2) assistance in the achievement by social sector institutions of their statutory goals and objectives;
3) promoting effective cooperation between government agencies and local governments with civil society organizations, as well as with international organizations;
4) attraction of additional sources of financing to social sector institutions that do not contradict the legislation of the Kyrgyz Republic.
Powers of the Council
The Council:
1) promotes the development and adoption by the founders of a strategy for the development of social institutions, as well as improving the quality of public services;
2) searches for and attracts humanitarian aid (investors, patrons) and other sources of financing for the development of social institutions that do not contradict the legislation of the Kyrgyz Republic;
3) reviews and supervises the execution of cost estimates for extra-budgetary funds raised for social institutions, as well as for the quality of food and medicines;
4) assists in solving current and future tasks, the development and effective functioning of social institutions, and improving the quality of work.
The Council may:
1) to make proposals for improving the activities of social institutions and improving regulatory legal acts in the field of education, culture, social protection, penal enforcement and healthcare;
2) to assist in the development and strengthening of the material and technical base of social institutions, ensuring the quality of catering, providing medical services, conducting mass sports, physical culture, recreation, socio-cultural, educational events;
3) invite employees of social institutions, representatives of state bodies, local governments, as well as interested organizations, specialists and experts to meetings of the Council.;
4) request documents or other information related to the implementation of activities (including extra-budgetary financial and economic) from relevant officials of the social sector institution, with the exception of information related to state and other legally protected secrets;
5) to establish permanent and (or) temporary commissions from among the members of the Council, as necessary.;
6) to get acquainted with the results of the inspection of the institution of the social sphere by the fiscal authorities;
7) submit recommendations to the authorized body on taking appropriate measures to officials, employees of social institutions based on the results of the activities of the permanent and (or) temporary commission, working groups in case of violations in the sphere of financial and economic activities and the norms of the legislation of the Kyrgyz Republic.;
8) to transfer to the authorized state bodies, their officials, law enforcement agencies materials on the revealed violations for taking necessary measures;
9) to study and summarize public opinion on the activities of social institutions and use the information obtained in order to improve the work of the institution;
10) assist in resolving issues related to improving the effectiveness of the institution’s activities;
11) participate in the consideration of proposals, applications and complaints from citizens regarding the provision of public services.
The Council is obliged to:
1) develop and approve the Council’s annual work plan;
2) carry out their activities in close cooperation with the administrations of social institutions, their founders, as well as with local governments, other organizations and individuals who provide humanitarian assistance;
3) to assist in informing the public about the activities of social sector institutions;
4) inform the public about their activities, decisions taken and their implementation through the mass media and the website of the state authorized body of the social sphere;
5) to analyze the effectiveness of public services provided and make suggestions for their improvement;
6) prepare annual reports on their activities and inform the public through the mass media or the official websites of the founders of social institutions;
7) attract additional sources of financing for social sector institutions that do not contradict the legislation of the Kyrgyz Republic;
8) submit reports on their activities at the request of authorized state bodies.
At Osh University of Technology, the members of the Council may be:
1) capable citizens of the Kyrgyz Republic with work experience in social institutions or public activities;
2) representatives of business circles, scientific and educational organizations, cultural and social institutions, non-governmental and international organizations, representatives of commercial and non-profit organizations, student and parent associations, as well as individuals who provide humanitarian assistance.
3). The Ministry of Education and Science of the Kyrgyz Republic establishes a commission for the selection and formation of the Council (hereinafter referred to as the Commission), and not exceeding 11 people.
4). The Commission may include representatives of state bodies, local self-government bodies and other representatives specified in paragraph 1 of this Article.
Rights, duties and responsibilities of Council members
The members of the Council have the right to:
1) attending meetings and meetings held in a social sector institution with the status of observers;
2) participation in the work of commissions and working groups established by the Council, the local “Kenesh” and the state authorized body of the social sphere;
3) initiation of early termination of powers of the Chairman and other members of the Council;
4) other rights provided for by the legislation of the Kyrgyz Republic and the charter of the social sphere institution.
The members of the Council are obliged to:
1) attend Council meetings;
2) observe the ethics of behavior of a member of the Board;
3) to comply with the decisions of the Council;
4) perform other duties established by the legislation and the charter of the institution of the social sphere.
The members of the Council, in exercising their rights and duties, must act in the interests of citizens receiving public services.
The members of the Council are responsible to the institution of the social sphere for the damage caused by their actions (inaction). At the same time, the members of the Council who voted against the decision that caused the damage, or who did not participate in the voting, are not responsible.
The members of the Council are responsible for violating the norms of this Law and other regulatory legal acts in accordance with the procedure established by the legislation of the Kyrgyz Republic.
Organization of the Council’s activities
The Council carries out its activities on the principles of independence, transparency, collegiality, integrity and legality.
The Chairman of the Council is elected by open vote by a majority vote of the total number of Council members for a one-year term.
Chairman of the Council:
1) organizes the work of the Council, as well as represents the Council in relations with state bodies, local governments and other organizations;
2) convenes meetings, determines the issues to be considered at the meetings of the Council;
3) preside over the meetings of the Council;
4) organizes the verification of the materials submitted to the Council;
5) organizes a synthesis of the results of the Council’s work and takes measures aimed at improving the organization of its activities;
6) inform the founder of the social sphere institution, the local state administration, the local kenesh and the state authorized body of the social sphere, depending on the departmental subordination, about the work of the Council;
7) performs other functions in accordance with the decisions of the Council.
- In case of non-fulfillment or improper fulfillment by the Chairman of the Council of his functional duties, his powers may be terminated prematurely by a decision of at least two thirds of the members of the Council.
The Council elects the Secretary of the Council from among its members.
By decision of the Council, persons may be engaged on a contractual basis to provide technical support for the secretary’s activities.
Secretary of the Council:
1) ensures the preparation of Council meetings;
2) notify the members of the Council of the date, time and place of the meeting, keep the minutes of the Council meeting;
3) organizes and conducts office work in the Council, as well as controls the deadlines for the execution of its decisions;
4) performs other functions in accordance with the instructions of the Council and its Chairman.
